Child Care – Terms & Conditions
Definitions:
The Agency means the Bunbury Agency Limited.
The Employer means the person engaging the Staff.
Permanent Staff means the person or persons engaged by the Employer on a continuous basis.
Temporary Staff means the person or persons engaged by the Employer specifically for any period, which is less than 3 months in any one engagement.
Daily Staff means the person or persons engaged by the Employer who are non-residential for any period whatsoever.
Residential Staff means the person or persons engaged by the Employer who live with the Employer or in the Employer’s property for any period whatsoever.
Full time Staff means the person or persons engaged by the Employer who work a minimum of 40 hours per week and are entitled to statutory holidays and sick pay.
Part time Staff means the person or persons engaged by the Employer who work a few hours per day or per week or less than 5 days per week.
The Engagement means the duration of employment of the Staff
- The Agency is a company registered in the United Kingdom whose registered office is at UHY Hacker Young, St Johns Chambers, Love Street, Chester CH1 1QN.
- The Agency acts solely as Agent on behalf of the Employer. The Agency introduces Staff to the Employer. The Employer is the principal and directly contracts to employ and pay the Staff.
- The Employer agrees to pay a Registration Fee of £25, which is valid for up to 3 months upon completion and return of this Agreement to the Agency.
- Registration will entitle the Employer to:
- The personal service of one of The Agency’s experienced personnel for a period of 3 months from the date of this Agreement or until the Employer engages Staff through The Agency, if that is sooner.
- Free listing of the position offered by the Employer on The Agency’s website and other appropriate websites.
- The Employer agrees to pay The Agency any expenses or disbursements incurred for additional individual advertisements, which are agreed with The Employer.
- All Staff (Full time or Part time) will undertake a Trial Period over 2 weeks from the date agreed by both parties, known as the Commencement Date of Employment.
- If Staff are engaged beyond the Trial Period, The Employer agrees to pay The Agency the following fees:
- Part Time Staff employed for less than 10 hours per week – 2 weeks’ gross wages + VAT.
- Part Time Staff employed for 10 – 24 hours per week – 3 weeks’ gross wages + VAT.
- Staff employed for more than 25 hours per week – £800 + VAT.
- Temporary staff (Full or Part time) – 25% of the total wage + VAT (or a minimum of £25 + VAT).
- The Employer MUST notify The Agency within 3 DAYS of the Commencement Date of Engagement.
- The Employer agrees NOT to re-engage Temporary Staff previously introduced through The Agency otherwise than through The Agency. Upon each and every re-engagement, the Employer agrees to pay The Agency a fee of 25% of the total wage + vat (or a minimum of £25 + vat).
- The Employer agrees NOT to pass any details of any staff to any other person or persons without the express permission of the Agency.
- The Employer agrees to settle all accounts within 7 DAYS of receipt of the invoice. The Agency reserves the right to charge an extra 2.5% to that account if the account is not settled within the specified time. A charge of 1.5% will be added if payment is made by Credit Card. There is no charge for payment by Debit Card.
- It is an express term of this Agreement that The Agency shall incur no liability whatsoever or howsoever arising from any act, default, negligence or otherwise of any Staff employed by the Employers through the Agency. The Employer agrees therefore to be fully insured against any liability that might arise.
- The Agency is an Equal Opportunities Agency and complies with current legislation including the Sex Discrimination and Race Relations Act and is in compliance with the Data Protection Act 1998.
- In the event of complaints and compliments please contact the agency directly and we will address the issue immediately.
- In the event of a dispute or difference arising under this agreement the law prevailing in England and Wales shall apply and any such dispute or difference shall be heard and determined by a court of Law.
