Au Pairs – Terms & Conditions
Definitions:
The Agency means the Bunbury Agency Limited.
The Host Family means the person/s who is offering the placement to the Au Pair.
Au Pair means the person placed with Host Family who will only work a maximum of 25 hours per week i.e. 5 hours per day, 5 days per week.
Au Pair Plus means the person placed with the Host Family who will work a maximum of 35 hours per week i.e. 7 hours per day, 5 days per week.
The Placement means the duration of the period the Host Family offers to the Au Pair.
The Placement Agreement is an official document and comprises ‘The Placement Schedule’ and the Terms and Conditions of the Placement.
- The Agency is a company registered in the United Kingdom whose registered office is at UHY Hacker Young, St Johns Chambers, Love Street, Chester CH1 1QN.
- The Agency acts solely as Agent on behalf of the Host Family. The Agency introduces Au Pairs to the Host Family. The Host Family is the principal and directly contracts to place and pay the Au Pair.
- Registration with the Bunbury Agency is free.
- Registration will entitle the Host Family to free listing of the position offered by the Host Family on the Agency’s website and other appropriate websites.
- The Host Family agrees to pay the Agency any expenses or disbursements incurred for additional individual advertisements, which are agreed with the Host Family.
- The Host Family agrees to give the Au Pair (subject to mutual agreement) a minimum of:
- £65 – £80 pocket money for 25 hours plus 2 nights baby sitting per week.
- £80 – £100 pocket money for 35 hours plus 2 nights baby sitting per week.
- Additional pocket money should the Au Pair be required, to work additional hours or additional baby sitting.
- The Host Family agrees to give the Au Pair a minimum of 2 free days (including the evening) per week as well as free time available to attend English classes.
- The Host Family agrees to give the Au Pair one week’s holiday with pocket money for every three months worked.
- The Host Family agrees to provide the Au Pair with their own bedroom, full board and make available all the facilities of the home.
- The Host Family agrees to treat the Au Pair as a member of the family and let them participate in family outings if they wish.
- The Host Family agrees to ensure that the Au Pair has sufficient free time to attend English classes and help the Au Pair find such classes, normally available in all towns. (English classes are not normally available in the summer months).
- The Host Family agrees to give two weeks notice to the Au Pair should they wish to terminate the placement.
- The Host Family MUST notify the Agency at least 14 DAYS before the Commencement Date of the Placement so as to ensure all the relevant paperwork has been completed.
- Upon each and every re-engagement, the Host Family agrees to pay the Agency the following fee:-
- Summer Holidays (6 – 8 weeks) £150 + vat
- Placements up to 3 months £200 + vat
- Placements up to 6 months £300 + vat
- Placements over 6 months £400 + vat
- The Host Family’s invoice will be issued along with the Placement Agreement. The Host Family agrees to settle all accounts within 14 DAYS of receipt of the invoice. The Agency reserves the right to charge an extra 2.5% to that account if the account is not settled within the specified time. A charge of 1.5% will be added if payment is made by Credit Card. There is no charge for payment by Debit Card.
- The Host Family agrees NOT to pass details of any staff to any other person or persons without the express permission of the Agency.
- The Host Family agrees NOT to re-engage any Au Pair previously introduced through the Agency otherwise than through the Agency.
- Should the Au Pair either they fail to arrive, be proven to be unsuitable or leave of their own accord within 28 days of arrival, the Agency will use its best endeavours to provide one replacement free of charge. If a suitable replacement cannot be found within 28 days, the Agency will refund 50% of the placement fee. This does not apply to Summer Holiday Placements.
- It is an express term of this Agreement that the Agency shall incur no liability whatsoever or howsoever arising from any act, default, and negligence or otherwise of any Au Pairs placed with the Host Family through the Agency. The Host Family agrees therefore to be fully insured against any liability that might arise.
- The Agency is registered with the British Au Pair Agencies Association (BAPAA) and the Association of Nanny Agencies (ANA) and abides by their codes of conduct and recruitment.
- The Agency is an Equal Opportunities Agency and complies with current legislation including the Sex Discrimination and Race Relations Act and is in compliance with the Data Protection Act 1998.
- In the event of complaints and compliments please contact the Agency directly and we will address the issue immediately.
- In the event of a dispute or difference arising under this agreement the law prevailing in England and Wales shall apply and any such dispute or difference shall be heard and determined by a Court of Law.
